Is there any firmware difference between say the TomTom 130 and 130s.
Put another way, if you loaded the software from a 130s into a 130,
would that make the two units identical (probably not legal). Is it ok
to format the unit then reload software using the os. There seems to be
a memory problem with 130s, I had to remove voices in order to install
latest updates.

Perfectly legal if you have both.

My guess is that they do use exactly the same software. The TTS feature is
provided by a hardware difference.
